BCP disclosure

Monness, Crespi, Hardt & Co., Inc.’s (MCH) policy regarding any Significant Business Disruption (SBD)
is to respond first and foremost by safeguarding our employees’ lives. We will then make an operational
assessment to quickly recover and resume operations, protect all of the firm’s books and records, and allow our customers to transact business.

In the event that customers are unable to contact us directly they will be able to access their funds and securities directly through our clearing firm, Goldman Sachs & Co. (GSCO).

Significant Business Disruptions (SBDs)
Our plan anticipates two kinds of SBDs, internal and external.

Internal SBD’s affect only our firm’s ability to communicate and do business, such as a fire in our building.

In the event of an internal SBD our clearing firm, GSCO, has locations within New York and New Jersey that can be immediately turned up for our use until our space is fully functional. In addition, we have the capacity to operate from an alternative office location unrelated to GSCO’s facilities: in Atlantic Beach, NY and Garden City, New York. These locations will definitely be utilized during an external SBD in the event that New York City is incapacitated and GSCO could not house MCH’s in temporary facilities because GSCO needed all available space for their own use.

Alternative Physical Location(s) of Employees
In the event of an SBD, we will move our staff from affected offices to the closest of our unaffected office locations at GSCO in New York or at the 30 Hudson St., Jersey City NJ locations. If GSCO’s office locations are unavailable to receive our staff, we will move them to: Atlantic Beach and Garden City NY 56 Wayne Ave Atlantic Beach NY tel # 516-371-0255.

Customers’ Access to Funds and Securities
MCH does not maintain custody of customers’ funds or securities. They are maintained at GSCO. If during a SBD, the telephone service is available, our registered persons will take customer orders or instructions from our locations listed as usual, and if our Web access is available, our firm will post on our Web site http://www.mchny.com that customers may access their funds and securities by contacting Karen Ferguson-Moran at our main number or at emergency contact numbers listed above.

However, if our firm cannot be reached for any substantial time period, customers will be able to call or e-mail the emergency contacts listed above at GSCO directly for assistance. The firm will make this information available to customers through its disclosure policy.
